Terms of Use

1. This agreement

These Terms of Use form a binding agreement between you and Oyorox ("we", "us"). By creating an account, connecting a site, or otherwise using the service, you accept these terms. If you are accepting on behalf of a company, you confirm you have authority to bind it.

Our Privacy Policy is part of this agreement. If you do not agree to these terms, do not connect a site.

2. What the service is

Atomic Site Manager consists of two parts:

• The connector — a free WordPress plugin you install on your own sites. It registers the site, sends a periodic heartbeat, polls for commands you queue, runs them, and reports the results back.
• The dashboard — a hosted web application where you view your sites and queue those commands.

The connector does nothing on its own. Without a Site Key from an active account, it stays idle and transmits nothing. The dashboard is the product you subscribe to.

3. The plugin's licence

The connector plugin is licensed under GPL-2.0-or-later. Nothing in these terms restricts the rights that licence grants you over the plugin's source code — you may use, study, modify, and redistribute it under the GPL's conditions.

These terms govern your use of our hosted service, which is separate from the plugin and is not covered by the GPL. Bundled fonts (DM Sans, Fraunces, IBM Plex Mono) are licensed under the SIL Open Font License 1.1; their licence texts ship inside the plugin.

4. Accounts and Site Keys

• You must provide accurate account information and keep it current.
• You are responsible for everything that happens under your account, including commands queued by anyone you give access to.
• A Site Key is a credential. Anyone holding it can register a site against your account. Treat it like a password: do not post it publicly, commit it to a repository, or share it in a support ticket.
• Tell us promptly at support@oyorox.com if you believe an account or Site Key has been compromised.
• You must be at least 16 years old to hold an account.

5. You must have authority over every site you connect

By connecting a site you represent that you own it or are authorised by its owner to administer it and to transmit its data to a third-party management service.

If you manage sites for clients, it is your responsibility to inform them that the connector transmits their site's user list — including user logins, email addresses, display names, and roles — to our dashboard, and to obtain any consent your own legal obligations require. See section 14 of the Privacy Policy.

6. Destructive commands are executed as instructed

The connector executes the commands your account queues. It does not second-guess them, and we cannot undo them for you. You are solely responsible for:

• Choosing which commands to run and against which sites.
• Taking a backup or snapshot before any change that could break a site.
• Verifying the result afterwards.
• Any data loss, downtime, or damage caused by a command queued from your account.

For your protection, remote deactivation and deletion of the Atomic Site Manager connector itself is blocked in the command runner. That is the only such safeguard; every other destructive action is available and will run.

7. Backups are your responsibility

The service can create database and uploads backups, but those archives are written to a wp-content/asm-backups folder on your own server. We do not store copies. If your server is lost, so are those backups.

Atomic Site Manager is not a backup service and is not a substitute for one. Maintain independent, off-server backups of every site you care about. We are not liable for data you cannot recover.

8. Acceptable use

You may not use the service to:

• Access, manage, or modify any site you are not authorised to administer.
• Break the law, infringe intellectual property, or distribute malware.
• Attack, probe, or overload our infrastructure, or circumvent rate limits, plan limits, or authentication.
• Resell, sublicense, or white-label access to the dashboard without a written agreement with us.
• Scrape the dashboard or use automated means to extract data beyond the documented API.
• Interfere with another customer's use of the service.

Breaching this section is grounds for immediate suspension under section 17.

9. The built-in SEO engine

The connector's SEO engine ships switched off and stays off until you enable it from the dashboard. Until then it adds no titles, meta tags, schema, feed text, or sitemap URLs to your site.

If you enable it while another SEO plugin is active, both will output title, description, and Open Graph tags, and search engines will see duplicates. Only one should generate metadata. Any effect on your search rankings from running two engines at once, or from the settings you choose, is your responsibility — we make no representation about search performance.

10. Availability and changes to the service

We aim to keep the dashboard available, but we do not guarantee uninterrupted service unless a separate service level agreement says otherwise. Maintenance, third-party outages, and factors outside our control can cause downtime.

We may add, change, or remove features. If we discontinue a feature you materially rely on, we will give reasonable notice to affected account holders. If the connector cannot reach the service, your sites keep running normally — the connector simply queues nothing and waits.

11. Plans, billing, and refunds

• Paid plans are billed in advance on the cycle you select and renew automatically until cancelled.
• Prices exclude tax unless stated. You are responsible for applicable taxes.
• You can cancel at any time from the dashboard. Cancellation stops the next renewal; your plan runs to the end of the paid period.
• We offer a refund within 14 days of a first purchase. Renewals are non-refundable.
• If payment fails, we may suspend dashboard access after notifying you. Connected sites keep running; they simply stop receiving commands.
• We may change prices with at least 30 days' notice, effective at your next renewal.

12. Intellectual property

The dashboard, its interface, the Atomic Site Manager name, and the logo are owned by Oyorox and protected by intellectual property law. Your subscription grants a limited, non-exclusive, non-transferable right to use the dashboard while your account is active — it transfers no ownership.

Your sites, their content, and their data remain entirely yours. We claim no ownership over anything the connector reports.

13. Third-party services

Commands you run may install software from the WordPress.org repository or another source you specify. That software is governed by its own licence, and we are not responsible for it.

The optional IndexNow integration sends data to a third-party protocol endpoint under the IndexNow terms. It is off by default and requires three separate settings before anything is sent.

14. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any command will produce a particular result on any given site.

The plugin is distributed under the GPL, which itself carries no warranty. Nothing here excludes liability that cannot lawfully be excluded, and some jurisdictions do not allow certain exclusions — in which case those parts do not apply to you.

15. Limitation of liability

To the maximum extent permitted by law, Oyorox is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, site downtime, or damage to reputation, arising from your use of the service — even if we were advised such damages were possible.

Our total aggregate liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100, whichever is greater.

This limit does not apply to liability for death or personal injury caused by negligence, for fraud, or to any other liability that cannot be limited by law.

16. Indemnity

You agree to indemnify and hold Oyorox harmless from claims, damages, and reasonable legal costs arising from your use of the service, your breach of these terms, commands queued from your account, or your connecting a site you were not authorised to administer.

17. Suspension and termination

You may stop at any time: disconnect a site from its settings page, or delete your account from the dashboard. Disconnecting clears the connector's stored credentials on that site automatically.

We may suspend or terminate an account that breaches these terms, that fails to pay, or that poses a security risk to our infrastructure or to other customers. Where circumstances allow, we will notify you first and give you a chance to fix the problem.

On termination, your right to use the dashboard ends. Sections 12, 14, 15, 16, and 18 survive. Account data is deleted as described in the Privacy Policy.

18. Governing law and disputes

These terms are governed by the laws of [jurisdiction to be specified], without regard to conflict-of-law rules. The courts of [venue to be specified] have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court to protect intellectual property.

If you are a consumer, you keep the benefit of any mandatory protections under the law of your country of residence. Before filing a claim, please contact us — most disputes are resolved quickly by email.

If any provision is found unenforceable, the rest stays in force and the unenforceable part is read down to the minimum extent necessary.

19. Changes to these terms

We may update these terms as the service evolves. The "Last updated" date at the top reflects the current version. For material changes we will notify account holders by email at least 30 days in advance. Continuing to use the service after a change takes effect means you accept the updated terms; if you do not, cancel before then.
